What does eIDAS say about legal evidence?
According to eIDAS, the legal effects or admissibility as evidence in judicial proceedings cannot be denied to data sent and received using an electronic registered sending service because they are in electronic format.
Data sent and received using a qualified electronic registered sending service benefit from the legal presumption of:
- Accuracy of the date and time of sending and receiving the data,
- Legal presumption of receipt by the identified recipient,
- Legal presumption of data integrity,
- Legal presumption of sending by the identified sender.

What does Decree-Law 12/2021 of 9/2 say?
We highlight, on the side, what is specified in Chapter II – Article 5 – Communication of electronic documents.
1. The electronic document communicated by an electronic means of communication is considered sent and received by the recipient if it is transmitted to the electronic address defined by agreement of the parties and it is received there.
2. The date and time of creation, dispatch or receipt of an electronic document containing a chronological validation issued by a qualified provider of trust services may be enforced between the parties and third parties.
3. The communication of the electronic document to which a qualified electronic signature or qualified electronic seal is affixed, by means of electronic communication that ensures effective receipt, is equivalent to sending it by registered post and, if receipt is confirmed by a confirmation message addressed to the sender by the addressee in the same form, is equivalent to sending by registered post with acknowledgment of receipt.
4. The communication of data and documents using qualified electronic registered delivery services,under the terms defined in articles 43 and 44 of the Regulation*, is equivalent to sending by registered post with acknowledgment of receipt…

What are the requirements for legally irrefutable communication?
According to eIDAS – Article 44º No. 1, qualified electronic registered shipping services meet the following requirements:
a) Be carried out by one or more qualified providers of trust services;
b) Guarantee, with a high level of confidence, the identification of the sender;
c) Guarantee the identification of the recipient before the delivery of the data;
d) The sending and receiving of data is secured by an advanced electronic signature or an advanced electronic seal of the qualified provider of trust services, in order to make it impossible to change the data in an undetectable way;
e) Any changes to which they must be subject for sending or receiving them must be clearly indicated to the sender and recipient of the data;
f) The date and time of sending and receiving, as well as any changes to the data, are indicated by means of a qualified timestamp; If data is transferred between two or more qualified trust service providers, the requirements of subparagraphs a) to f) apply to all of them.
